Empower yourself by actively shaping outcomes that align with your best interests, instead of relinquishing control to the Federal Circuit and Family Court of Australia.

In mediation, you hold the reins and have the ability to influence the decisions that are made. It's all about reaching a mutual agreement, ensuring that you never feel compelled to make choices that you believe are not in the best interest of yourself and your family. Your needs and preferences take center stage throughout the process.

Is your matter in Court, or headed in that direction?

Stop! Let's sort it out.

When legal proceedings commence, the atmosphere can quickly become tense and amicable communication can seem impossible.

However, within the realm of mediation, there exists a unique chance to engage in genuine conversations with the other party, fostering an environment that is both safe and confidential. Unlike formal court settings, mediation provides an informal space where dialogue can thrive.

At Access Family Law, our objective is to ensure that discussions remain centered on the pertinent issues at hand, rather than getting entangled in conflict. We excel in maintaining focus and facilitating productive conversations that pave the way towards resolution.

Mediation Benefits

Why Mediation?

The benefits of Mediation outweigh the benefits of court, enquire today and find out if medation is the right option for you.

Reduced cost

Generally the cost of mediation is far less than the cost of a matter proceeding through the Court system. Traditional litigation can be very expensive and the total cost is highly unpredictable.

Confidentiality

Everything said at the mediation is confidential and it allows you to make genuine attempts to settle the matter on the day, without needing to worry about how those offers could effect you later.

Faster outcome

Because mediation can be used early in a dispute (or at any time during Court proceedings), an agreement can usually be reached far quicker than if the matter remains in the Court system.

Convenience

Mediation can be arranged in person, by video, or by telephone. We can also arrange for the mediation to take place by "shuttle" which means that you and the other party don't need to directly communicate at any time if you don't wish to do so.

More control

Mediation increases the control that you have in resolving your dispute. Rather than having the Court decide, you and the other party get to work towards resolving your own matter on your own terms in a safe, informal environment.

Greater satisfaction

Parties usually report higher rates of satisfaction when they've been able to resolve a dispute between themselves. We also find that parties can be more dedicated to upholding the terms of the agreement when they've resolved it themselves.

Simple Pricing

Court costs can be tricky, but our Mediation prices are simple!

Our fees are usually shared equally between both parties (unless one party has offered to fund the mediation themselves):

Half-Day Mediation
$ 1,500 For up to 4 Hours - PLUS GST
  •
Full-Day
($1,500 for the first 4 hours), then:
$ 350 p/h For each additional hour over 4 hours - PLUS GST

FAQ

Common Mediation Questions

Still have questions? Please get in touch!

The cost is usually shared equally between the parties. If you have a lawyer, we will ask them to confirm that they hold your share in their trust account prior to mediation.

We offer a flat fee for a half day (4 hours) then charge $350 per hour if the parties agree that more time is required.

We proudly offer online mediation services Australia wide, using either Microsoft Teams or Zoom (whichever is more convenient for you).

We strive to ensure that our mediation services are available to clients in rural and remote areas, without the need to worry about the time, cost and stress of travel.

Prior to the start of the mediation, we will require everyone participating (lawyers and clients), to sign a confidentiality agreement.

This ensures that everyone understands that what is said at mediation cannot be used later in Court or disclosed to other people.

There are some exceptions to confidentiality including risk issues for children, threats to harm people or property and some other exceptional circumstances that might require the mediator to make a report to Police or DCJ.

We certainly hope you do!

Your agreement can be drafted into Consent Orders, a Parenting Plan, Binding Financial Agreement or other document that you and your lawyer think is most appropriate.

We can offer assistance to the parties to sign agreements digitally where appropriate, using our advanced technology.

Sometimes parties just can’t resolve the dispute. Even if the entire dispute isn't resolved, sometimes we can at least "narrow" the issues in dispute, by figuring out what is and isn't agreed.

We sure can!

Your 60I certificate can be used for up to 12 months, to show the Court that you made a genuine effort to resolve your dispute.

If mediation doesn't take place, we can offer a different type of s60I certificate. Contact us to find out more!
